An Important Update About the Future of Skunktek

We wanted to take moment to share an important update about proposed federal legislation that could have a major impact on not only Skunktek, but the entire cannabis seed industry.
For the past several years, cannabis seeds have generally been considered federally legal hemp because the seeds themselves contain less than 0.3% THC. That interpretation has allowed seed banks like ours to operate and ship genetics throughout the United States.
However, a new federal law changes how cannabis seeds are defined. Instead of looking at the THC contained in the seed itself, the law looks at what the seed is capable of producing. Under this new definition, most modern cannabis genetics would no longer qualify as hemp.
The legislation includes a one-year transition period, with the new definition expected to take effect in November 2026.
If the law takes effect as written and no amendments or exemptions are made before then, Skunktek, and businesses like ours, will likely no longer be able to legally operate under our current business model. In practical terms, that could mean we are forced to shut down or dramatically change how we operate.
While there is still time for Congress to amend the legislation, for regulators to issue additional guidance, or for legal challenges to change the outcome, the future remains uncertain. Many organizations across the cannabis and hemp industries are actively working to advocate for changes that would protect cannabis genetics and seed preservation.
With that uncertainty in mind, we’ve made the decision not to wait until the last minute.
Over the coming weeks and months, we’ll be releasing a number of new drops, bringing back favorites, and running some of the biggest sales we’ve ever offered. Our goal is simple: get as many packs as possible into the hands of the community while we still can.
If November arrives and nothing has changed, this could be the last opportunity for many of these genetics to be made available through Skunktek.
For now, Skunktek remains fully operational, and we’ll continue doing what we’ve always done: preserving great genetics, supporting breeders, and serving this incredible community for as long as we’re able.
